if you were dealing with a reputable breeder she will have had you sign a health contract, in that contract it will say weather she will give you a replacement pup or a full refund

Oof! Not a good deal. I am sorry for your troubles...

You can certainly take this breeder to court over this to get your money back, considering that you've tried simply approaching her about it first.... You paid for a puppy, you have no puppy. If she registers with the AKC, you can report her as well, though they will most likely want proof.

Make sure you ask the next breeder for references and make sure you call said references! Ask a *ton* of questions, and if you make a deposit on a puppy, get a receipt! Find a breeder that gives a health guarantee, too.

The AKC site gives you a list of questions to ask a breeder to help you choose one that is responsible. http://www.akc.org Always research the breed you are looking for so you know what questions to ask about their health.

If you purchased this dog from a reputable breeder, you should be able to get your money back (maybe minus a small fee). As the dog was under that person's supervision, you are not liable, and you should get a refund. Check with your local business associations, and the breeders around you to ask what is usual.

not sure what country you are from but here in the united states ,,, if you were not given a refund since the puppy died before you got it, you would take the matter to court. i would say small claims court. i am not really sure on that one since i have never had to do it myself. boy, don't i feel dumb since my son is an attorney!! just call your local police dept and i am sure they will guide you in the right direction. you deserve your money back since your puppy died before you could bring it home. which i am very sorry to hear. that is really sad.
