What Constitution are you reading ? It doesn't
mention murder and it doesn't mention the death penalty either. What it does mention is the right of the defendants against an overly zealous government.
Recent court challenges have not been about whether or not people should
be executed ;
But rather does the way they're being executed violate the prohibition against cruel and unusual punishment ?
To the death penalty advocates out there realize that you have one huge flaw in your argument, You have to accept the fact that 12-15% of the people that you execute are going to be innocent. Former Governor George Ryan of Illinois realized that and decided that it was an unacceptable number- he stopped capital punishment in Illinois. Sort of an all or nothing approach.

The death penalty isn't murder. Justice, in its purest, most essential form, is when somebody violates the right of somebody, and has his same right removed by those with authority to do so. When somebody murders another, he has violated their right to live, and in turn his must be taken by the correct authority. It can be argued that men can never have the authority to deliver justice, and maybe it's true; we're not perfect, who are we to claim the right to punish? But when we agree to live in America, we have agreed to give the government the right to serve justice over us, because we would want justice for ourselves if we were the victim. Therefore, when somebody kills, they deserve the same, and the government is responsible for seeing that they get their fate.

Throw the whole thing out? Nah. All you need to do is amend it so that capital punishment is unconstitutional. No need for a revolution.
