I pressed charges against a guy and he was picked up yesterday afternoon. He has been in trouble with the law before and has been in jail. How long will he have to be in jail this time? Does he have to stay in jail till he sees the judge or what? I am kind of scared for my safety. I am afraid that he will get out of jail and come after me. Someone broke into my house before he was picked up and I think it could have been him. What is the best thing for me to do?

The length of time he'll spend in jail varies from jurisdiction to jurisdiction. More than likely he will be bonded out. Go to your local court (Municipal, Circuit, Superior Courts) and fill out the papers for a restraining order and have the Sheriff serve him while he's in jail (there will be a fee for that). Sometimes, depending on the jurisdiction, you can have the restraining order within 1 to 2 hours, others within days. The first restraining order will probably be temporary and you will most likely be given a court date within 2 weeks to appear and make the Order permanent. You should make sure you give a copy of the temporary and permanent Order to each law enforcement jurisdiction (city, county and state law enforcement agencies), always keep a copy in your car, purse, office, etc. In the event he does show up, you will have a copy with you, the local law enforcement agency will have one on file and there will be absolutely no confusion. Been there, done that.

Call your local police dept and voice your concern. if he was picked up on aa assult charge you may be able to get a temp restrainig order. The judge if he's let out on bond will probably tell him its in his best intrest to stay away from you until the hearing. If he doesn't post bond and the jails not overcrowded chances are he'll have to remain there until the triall.But that really depends on on a variety of things.He probably can post bond as long as he has the money even if he has priors. if you're worried he'll come after you,even with an order in place they're are local safe house shelters for women that are very nice not like your typical shelter. You can call the jail at anytime and check to see if hes been realeased.Good luck:)
Additional info:the first time he see a judge is only to plea,they wouldnt release him w/o posted bond or final judgement or court bond,(which they typically dnt hand out in assult cases).Dont buy a gun. It could be used against you if hesitated to shoot and he overpowered you. Every state is different but in all its really hard to get a restraing order but it shouldnt be hrd to get a temp one put in place. Call your local county DA for more info on filing a real one.Again dnt know if your state allows them but here in Tejas we're allowed stun guns. You can find a good cheap one at a local pawn shop and you may feel more confident about using that over ending his life.

I don't understand what charges for "harassment" are - was he stalking you? He may have to go to jail if he is violation of his probation (if that is the case based on his prior trouble). He will have an opportunity to appear before the judge and a bail amount will be established. If he can post bail, he can get out right away. If he can't, he will stay in jail until his trial date. You can request that the police notify you if he does make bail and you can ask that they make patrols of your homw because you are fearful of him coming after you. You can seek out a restraining order to have hi arrested again if he comes near you. Good luck.

Buy a pistol
Depends on the charge.
He saw the judge this morning and probably two weeks till he sees a judge again if he can't make bail.
There he can plead guilty and be charged or go back to jail for trial or post bail.
Ask a friend to stay over or go stay at a friends house.

In Michigan here there is something going around that if you have a CCW permit and you feel your life is threatened even in public you can shoot them and not even go to court.

I'm sure you didn't know he was bad before you knew him, I sure didn't know that about my ex husband.

It depends on what state you live in. In Indiana, they stay in jail until they see a judge, which is usually the next morning unless it's a weekend, then it's Monday. They can also get bailed or bonded out. And if he's intoxicated they'll let him sleep it off overnight. You can get a restraining order to go along with the charges you pressed on him. I don't know what he did.. but depending on the severity and his mentality, you might want to talk to a prosecuting officer about your options. Good luck.

Get a restraining order to start with, that way if he contacts you he will go back to jail. As for how long he will stay in jail, that all depends on the charges that were filed.

harassment is only a violation of the law, the lowest charge. the most time anyone could be sentenced on a violation is 15 days. however, once he is arraigned by the judge(the day after his arrest normally) he will more than likely be released. you should contact the district attorneys office and request an order of protection. any violation of an order of protection will result in more serious charges. good luck.

First ,call the jail where he's at and ask how long he has.Then,explain the satuation to who ever you speak to at the jail.Ask them can you get a restaining order on him before he get out,and and go stay with a friend,are a family member.The answer these other people wrote on here ignore it.if you buy a gun you puttin youself into trouble,so that not a good ideal.Never go anywhere by yourself always have someone with you.You wouldn't be safe if you decide to go home and you live by yourself ,get a dog.At lease they would let you know if he try to enter in you apt are house.If it were me and i were in a situation i wouldn't stay by myself and i wouldn't go out byself(like store ,are a bar etc etc,Just fine out much as you can about him gettin out.Never be along and also pray.for protect .Just watch your back.

what you will have to do is get a order out on him go to a lawyer they will help you sort it out Hun
i would do it now because you need it sorted before he is released
if you still don't feel safe maybe you would be better of moving away some were new

hi Char. I agree that if usual everybody is jailed, they ought to get in line for early launch clone of a few thing of them. i'd opt to carry close how the different inmates sense about that.
