I live in california, and was wondering what the rules are or punishments for someone who was driving on a suspended licence but driving his mothers insured vehicle. Can he be insured with a suspended licence in california?

Mom's insurance company is within all rights to say that Son has a suspended license and is not covered to drive this vehicle. However, they may still pay.

As for you, if you have insurance, ask about Uninsured motorist coverage. It's required by law in most states, and you probably have it. Contact your insurance company and file a claim. Your company can then subrogate (sp?) the claim to Mom's and try to make her company pay, and you won't have to worry about anything.

Also, the deductible on Uninsured Motorists is usually quite less as well.

Good Luck!

He cannot be insured because he was not allowed to drive on a suspended license. the person has abused their PRIVILEGE to drive. Moms insurance will not pay out because son was driving illegally. You will need to sue mom if son was a minor. Your insurance will pay if you have uninsured motorist coverage.

I beleive that it would be there would be points addd to his driving record only and a heavy fine and his Mom's insurance would pay you if he was the one at fault and his mom in turn takes care of the person that drove her vehicle

and I think that person that was in the accident under suspension
will be more tacked on time before he gets his license back

second time is fine, time and jail

third time is heavy fine surender licene and jail time

the penalty for driving while suspended is $1000 fine and or 6 mos in jail and as for the damage in california if my property(car) in any way damages you or your property(car, bike, house, shopping cart etc.) i would be responsible and my ins. company is legally bound by my policy to protect me from incurring damages ie. from the resulting lawsuit. so there i hope that helps

If you were just the passenger, then what are you so concerned about? Let the LOSER friend worry about his/her consequences!

I have reason to believe that you are the driver.
