The judge asked me if i wanted a court appt lawyer, i told her no, but i didnt know i had been charged with driving while liscense suspended, i was just going to plead guilty to the judge and get whatever she gave me with over, my court date is in august, can i still get a court appointed lawyer or do i have to hire a private one now?

If you cannot afford a lawyer, one must be appointed for you under the Sixth Amendment. If your county has a public defender, call their office and ask to make an appointment. If there is no public defender's office, call the clerk of the court and indicate that you would like to speak with whatever attorney may be up next on the indigent panel. Good luck. Your original waiver of counsel is not binding if you change your mind early enough (you have).

That will be up to the judge. Refusing a court appointed attorney isn't necessarlily a waiver of counsel. Check with the PDs office or the court clerk. Do expect to be made to jump through more than the usual number of hoops, though. The judge may look at you as wasting the court's time; that's not a good thing...

Yes, you can still avail of the court appointed lawyer, its not yet too late. You can also hire a counsel of your own choice, but, financially this will be another burden on you. Do it as early as possible, as the previous answer said, they (Texas Court) are pretty serious even in a minor case. Good luck, Bro.

I believe you can stop and advise the judge that you've changed your mind. If I am not mistaken in the case of Gideon v. Wainwright where legal representation was addressed, this was added into the courts decision as well, that a defendant can change their mind at anytime during the proceeding and request legal representation and the judge has to honor it. The proceedings should stop until legal representation is found.

I would first go to the prosecuting attorney and ask if he/she will drop/lower the charge. If not I would walk into the judges courtroom, go to the place you pay tickets ask them to get you file and take it to the judge and when she calls you ask her if she would let you have a court appointed attorney. Yes you can still get one. When you go to court ask for one. You most likely said no to one at magistration at the jail

you ALWAYS have the right to a court appointed attorney, if you request one they MUST provide one as per the miranda act. go to your county or district attorney's office and tell them your situation and that you request a court appointed attorney.
