if a neighbor girl is up in a tree that overlooks my back yard bordering her back yard and she is watching adults in my back yard who are socializing... and i ask her to get down and she says you "can't make me..." and i spray her with a hose, is that considered assault like the local police department said.??? only serious answers please!!!!

as a matter of fact... yes we were all half naked in there... don't be mad that you weren't invited!!!
fyi- when i spoke to the father all he did was allow her to continue watching, and i did not feel that was appropriate

Why don't you just pull her out of the tree and spank her butt? Or a fire hose to knock her out of the tree?

That is definitely under the legal definition of assault. Again, the LEGAL definition. The cops wouldn't threaten you with that if it weren't in the books as a crime.

How about acting like a 'grown-up' and telling her parents to monitor and curb her behavior? That way, if she continues to do this then you have the grounds to call in the cops. They will then admonish the kid's parents to control her, and you avoid trouble. Serious enough for you?

And you are an a'sshole for stooping to the level of spraying a child with a hose just for watching your party. What are you doing; smoking drugs and running around naked? Punk!! Douchebag!!!

Someone can be charged with "assault" for just Threatening to perform any sort of attack so the answer to your question is yes.

PS: I agree with the Other poster who said the girl could be charged with "peeping" or even harassment. I'd call the cops, hide the stash, tell everyone to get their cloths on, and make sure Everyone in your party tells the cops the Same story!

If the local police said it's assault, then it is. Technically, you sprayed the girl on her property which is a form of tresspassing, even if it was only done with water, it still amounts to assault. But you might want to look into provisions of Provoked Assault, which is substantially less of a penalty than straight assault.

Man ROCK ON and spray her as* again or better yet get a bucket of fire ants and throw them in the tree at night. The next time her as* goes up there shell regret it. If her parents wont stop her then its up to you or the police and since we know what they are going to say based on this experience its up to you. I hate nosey people dont they have anything better to do than sit in a tree and watch yall (unless you were makeing porn)

You should be considerate to curious children in your area. If you don't like having kids around then you dhould move to a place where there are no kids. Kids are known to do stuff like that. They are naturally curious.

A child can definitely be up in her father's tree on her father's property and whatever she happens to see from that tree is called public exposure. You neighbors should learn to respect eachother and tolerate eachother.

Yes for sure. However annoying a child is, they're still only children, intentionally spraying her with a water hose is wrong.

Yes, it is. To avoid the problem the first thing you should have done is talk to her parents then called the police to report them if nothing was done.

unfortunately it is. its a very very mild case of assault though. why don't you ask the girls parents to tell her to get down?
