Yes, they can stop breathing. This is especially true of defenseless toddlers and young children 5-9 or so. The older the child, the more ability they have to get free of someone tickling them. As far as the legal issues are concerned, If I tickled someone to death, I'd imagine i'd be shopping for a lawyer shortly after I was bailed out of jail.

I think it could be possible due to asphyxia, causing a heart attack through over-exertion, or just the "ticklee" thrashing about wildly to get away from the "tickler" and cracking their head against something.

Actually, tickling has been known to cause a heart attack.
The "tickler" could be convicted of involuntary manslaughter.
