It can be used or new. I would prefer it not to be one of the more expensive brands like Mercedes-Benz or BMW because their not good on gas.

And something with a some room in it, though I'm aware that most droptops dont have much room in the backseat. And I'd like it to be a 4 or 5 seater.

A used one is probably the only option for under 10,000. Try www.Craigslist.org, just choose a region close to your home and it gives you lots of realistic listings from serious sellers. Always be careful when you're purchasing/contacting a seller online, be aware of fraud and such. Goodluck buddy =D
