NOPE!!! a big fat nope, he would have to have a paternity test done, which if it proves he is the father he has to pay for out of pocket..-smirks- and if he doesn't want to pay for it...-smiles- He can't have ANY rights...whatsoever...

Ok, my sister has delt with this issue in FL. Her ex didn't sign her daughter's certificate either, but he wasn't willing to leave the mother alone. He decided he would use his daughter to get to the mom. First, he tried to say he was the dad, but she said he wasn't and he had to prove it. He had to have a DNA test done and he Says that when it proved him the dad, he was able to petition to have himself added to the BC. However, being proved the dad got him caught with another problem - he now was obligated to pay child support. In most states, it can be made a condition of support. To explain - if he pays child support, he has the right to at least know the whereabouts of the child. If he doesn't pay, he forefits the right to see her. In some cases, where the man is dangerous or Very bad for the child to be around him, you can go through the courts to restrict him from seeing her, or the courts can enforce a supervised visitation deal, where he would not be able to run off with the child by himself.

Yes the biological father always have rights even if they don't sign a birth certificate ! as long as the father establishes paternity he has rights to the child until age 18

No, he doesn't, because he's not legally recognized as the father.

If it's an issue of whether or not he wants rights, and you don't want him to, then tell him he needs a blood test to prove he's the dad, then tell him that he has to pay for it.

He can be added to the birth certificate easily if you both sign an affidavite stating you both agree he's the father, all for free. But if it's something different, if you don't want him on there for whatever reason, or if he's refusing to acknowledge it, then you guys need to doa blood test. He can sue you for that, but it was my understanding when I went through it, that the person who sue's is the one who has to cover all the blood testing costs.

Did you list him as the father? Do you want him to admit to being the father? You could contact your local CHILD SUPPORT ENFORCEMENT UNIT and they will get the DNA test done and he will have to be responsible for the fact that the baby is a result of the two of you being together. I have heard but do not know that a child can sue for past child suppport when they turn 18. The main thing is take care of yourself and your child good luck.

No unless he's paying Child Support. Signing a Birth Certificate is just one of many ways to establish paternity. Paying Child Support is another.

The only way he will have visitation rights is if he takes a paternity test ( blood test) to prove he is the childs father. He has no right to even SEE him until that is done! If you want him to see his son- ind but LAW wise- u dont owe him anything!!!

The father of this child does have rights...He has the right to pay child support.....Get yourself a DNA testing done from this father and have the State go after him for support of this child!

The father does have rights if he is proved to be the father and pays child support. I go threw this with my son and his father.

Not unless he himself goes to court to get a blood test (which he will have to pay for) to prove that your son is his. I would not let this man have the child, if he wasn't man enough to sign the certificate and don't contribute to his upkeep, he has NO rights whatsoever. If he would take you to court, you make sure you head to Domestics to get the money due your son!!!!

NOOOOOOOOOOOOOOOOOOO!!!!!!!!!!!!!!!!!!!! Take it from me i'm dealing the exact same situation now. My daughter's dad did not sign her birthcertificate and we are having to go to court so that he will be order to sign a legal document stating that he is my daughter's father and it depends on what state you live in.
