isn't it sad that some people would have to resort to that? a prime example why abortion should remain legal.

Hmmm, so you people saying yes are OK with women having babies that have been raped. They already have to live with that horrifying experience why give them a child to remind them of it too. But anyway the point is if abortion is made illegal then you just answered your own question before you even asked it. What degree of murder would be the question here. If the supreme court considers a fetus a living being then yes I guess it would be murder. With advances in medicine today the definition of this has completely changed. Now you can have a premature birth and have a much better chance of the baby surviving than it would have centuries ago.

Drumrchick, don't be ridiculous.
The only time someone can be charged in most states is when the fetus would have been old enough to survive outside of the womb. I believe in NY, the baby would have had to take a breath outside the womb to be able to charge the offender with murder.
A fetus under 12 weeks old is not yet a person, not yet human.
If the US bans abortions, I will start to seriously consider leaving the country. They are slowly trying to take all of our rights away based on their right wing republicanzi Chrisian propeganda, and I am running out of patience for it.
As for the original question-yes, at the very least, she would be charged with seeking an illegal service, something similar to solicititation.

If it were illegal and everyone considered a fetus a child then yes, most likely the mother would be charged with murder and I'm sure the people who performed the abortion would face charges as well.

Whether abortion is legal or illegal doesn't change the fact that the act results in the death of the unborn child. If the child should survive the abortion itself and come out still alive, killing it at that point is murder and can be prosecuted as such.

I personally think abortions should be illegal. And yes more then likely if they were illegal the mother would be charged for manslaughter.

If it was illegal absolutely Yes. They would charge me with murder if I hit her with my car while she was pregnant. I wonder if she was on her way to have an abortion and she said it was ok would the judge let me go. That is just sad..........

Thank God we live in a country where we will always have a choice. Just as the above post said, she would die in a back alley somewhere having an illegal abortion.

Probably. Oddly enough, in many states, if a person kills a pregnant woman, he can be charged with double murder. So sometimes a fetus is a person, sometimes it isn't. Just depends on how the prosecutor feels that day.

Yes... but chances are, the mother would die as well... illegal means of abortion usually isn't safe. But, of course, most people would say "good, she deserves to die" so I guess that doesn't make a difference.

yes and she should be. I think she should be now as well. Ok all you people "it is a females right to do as she wishes with her body" Who asked the baby? What gives you the right to determine a poor Innocent babies fate? My mother choose life, how about yours? Maybe your mothers should have chosen to murder, abort, not be responsible for her actions.
