My 17yr old just had a baby and the father is 16. Does she need my permission to give the baby the father's last name instead of hers?

No. You have no legal input on the matter, Minors or not, naming the child is a privilege for the PARENTS. They were grown enough to make the baby, they should be grown enough to name it what they wish. It's really not your business. :(

p.s FYI - Paternity does not have to be established to give the child the "father's" last name, that's only necessary if child support is being sought. Also, custody is not contingent on the child's last name, but which parent can provide a more stable home for the child.

See, you are done now! It is no longer your right to control what she does. If she wanted,she could have herself declared an emancipated minor. Basically, you had a job to do and you screwed it up. Let's hope she makes a better mother than you did! Naming the baby is her business, but if it makes you feel any better: In the state of Texas where I'm from I know from personal experience that if you want to give the baby the father's name(even if the father is your husband), it is required that he be there with his I.D. to sign off on the birth certificate if he wants the baby to have his name! If the mother is trying to deny he is the father, and make him establish proof of paternity, then she should just leave the father's name off the certificate. If he wants to have a part in the baby's life, all he has to do is go to court and request a blood test to establish paternity. Most guys won't do this!

No, you have the right as the mother to give the baby any name you wnat to give the baby. You can name the baby Moon Stars if you want. Research on line and you will find that it is the mothers right to name the baby anything she wants and if you are a minor having a baby with a minor, that boys parents are liable for child support until he turns 18. So make sure your parents file for child support and sue his parents, so your baby gets what it needs.

I dont think so as the legal parent of the baby she can give the baby any name she wants. By right the baby should have the name of the father and not your last name. This one can be chalked up as a lose.

No, the mother can give the baby whatever last name she wants. The father needs to sign papers claiming paternity in order for his name to be on the babies birth certificate in the father area.

No, she needs no permission from you for anything to do with her child. She is the mother and has total parental rights over the baby. She makes all legal, medical etc. decisions for her baby.

No, but the father will have to have a DNA test done. Paternity has to be established on every child born to unmarried parents.

The Truth: I have 2 kids by my fiance and BOTH times the child support enforcement made him esablish paternity before he could singn the birth certificate. We live together and I've never had child support taken from him. It's if the birth parents are unmarried that paternity has to be established.

Nope. She can give her baby whatever first, middle and last name she wants.

I had a baby out of wed-lock. My boyfriend (now my husband) had no problem signing the birth certificate so the whole thing about establishing parternity... nope. Atleast not in Ohio. It does depend on what state you are in though.

no you dont need permission.. it is up to you.. I was 17 when i had my baby... but you have to think about the upcoming proms.. if y'all dont stay together he can have a chance of custody of your baby because it has his last name...
