my dad recently passed away and when i was born mom was told that due to my disability i will recieve his v.a. the rest of my life, now that he is gone i called the v.a. and told them of his passing and i asked what i need to do to start reciving his benefits, i was told I'm not eligible to get anything now that he's gone, i need a lawyer

Well, if you already know that you need a lawyer, you aren't going to find one on here.

First, formally apply for benefits. Submit all necessary paperwork. Answer any questions completely. Submit documentation of your disability. Then wait for the VA's formal written reply -- acceptance or rejection. Once you have that, then assess what you need to do next.

Getting a lawer will not help. Just because your dad had benefits, they do not automatically pass to you. You can get benefits while he is alive, or even if he was in prison, but once he is deceased, they dont have to pay you anything as you were not the one in the service. Sorry.

Contact your nearest Disabled American Veterans office they are usually located in the Federal bldg, under service organizations.
If anyone can help you it will be them. A lawyer would be useless when dealing with the department of veterans affairs.

I suspect that your mother was misinformed.

Veteran's benefits are not hereditary.
