because the law is made by humans which have a flaw like them and helps criminals escape such a situation but on the other side , it also helps serve justice to those who are caught but are innocent

We would be in violation of the Geneva Conventions and would be committing an immoral act to execute a captured enemy combatant without affording that individual the right to due process. Just the same as in The United States, we assume innocense until guilt is proven.
It has recently been ruled by The Supreme Court of The United States that our ratification of the Geneva Conventions treaties must cause us to apply the outlined humanitarian standards (from the treaties) to captured terrorists.

it would be politically incorrect. Many insurgents could be using their childeren as detonators. Who knows. There is also the possibility that we may mistakenly identify someone important and cause strife. What if the terrorists were with their criminal underlord friends and the "Team america global anti-terroist attack group" comes in from nowhere and shoots up the terrorists. Then the friends return fire and **** escalates. I think that sometimes the terrorists need to live in the imfamy of prison before they get to die. There may be worse things after death. Maybe death is like hell for everyone except for people who have faith?

The accused are still innocent until proven guilty beyond reasonable doubt. Thus, even if the evidence is already strong against the terrorists, they still have the right to trial. That is the irony of the judicial system.

Because
1 they could still hold usefull information about things such as weapons of mass destruction etc
2 they could want to die, dying wouldnt be a punishment, it would be the easiest way out
3 they could be used as evidence to convict other terroist
4 how would u like it if you hmmm stole something and where thrown in jail tht same day witout a trial, everyone deserves to be heard, even if they have did something extremely bad i mean theres many answers to this question

The fact of the matter is, NO REAL terrorist is ever being caught. A devoted terrorist commits suicide before he/she is caught, or he/she dies in their mission. All these you have seen caught and accused of terrorists are just people who are accused of being a terrorists and that is why they are been held.

Well, they are presumed innocent until proven guilty, being guaranteed due process. That is if they are charged as criminals. If considered prisoners of war (Gauntanamo Bay), then they are handled differently. Then again, there is a certain Mr. Zarqawi (deceased) who might disagree with this whole discussion.
