Homelessness is a major issue everywhere; our small Northern California town is feeling a major impact and our town has tried really hard to have services to help folks. There is a man that stands across from our store holding a sign asking the public to boycott us. The only connection that we have had with him was to call the police because one day he was being particularily obnoxious and abusive. His whole gig, which he had admitted to, is to tie up our small police force ( 2 officers at a time) as much as possible..tape recording every conversation and filing complaints against officers stating abuse.The police station has a huge stack of his complaints. Knowing that that is his gig I dont want to give him any encouragement to keep it up, and hope daily that he will resolve his private vendetta. I fully understand his right as a fellow human being to freedom his speech.. but, last weeks sign "all christians should be fu@$ed with a crucifix!" was just too much. He hassles EVERYONE!

He is across the street from us and knows his rights well enough to not do anything "legally wrong"
a police officer told me that basically their hands were tied and suggested a restraining order...that way they would at least have something legitimate to charge him with. I suppose that I was wondering if there was anything else and also what exactly would constitute need legally for that order...whew! I appreciate your imput tremendously.

Well you should contact your police department and see if he can go to jail for false complaints. That is a misdemenor and multiple false complaints can become a felony depending on your jurisdiction. If your local police cannot do anything because of resource retrictions, call your country sherriff, they can enforce all of the same laws in your county as the police can. If this does not work, contact your representative or congressman/woman with a message marked urgent with the complaint. You should do this even if you find a remedy with your sherriff or local police.
Also, if you make several complaints about this guy and they are legitimate claims, then you should keep track of every time you make a complaint. Good luck, I live in a large city and I know how it is.

Has he personally harrassed you in any way, such as yelling at you in the parking lot? If he has, file a complaint, and get a restraining order. That will keep him a specific distance from you, which should be sufficient to your needs.



If not, If he has said anything bad about your business, take him to small claims court. You can sue him for money, but tell him you will settle out of court if he agrees to keep his distance from your store. If he agrees, make sure it is documented so it can be enforced.

I would continue to call the police and be cautious. I'm sure that other people don't care about what his signs say it is just that he could be dangerous. It appears that he has mental problems or he wouldn't be in the position that he is in and acting that way. If he were normal he would be at work too.

Go with posting 'no loitering' signs. Talk to a lawyer, it's tough under the circumstances, you may be able depending on your local ordinances to charge him with public obscenities and depending on who the local judge is and their interpretation of the local laws...possibly a communicating a threat charge

The other alternative is to pay him off to go boycott your competition!

WOW! cant believe that some ppl would be that rude to older ppl, and they are not the only ones to use coupons, working ppl Use coupons as well, and it doesnt take that long to scan the coupons, im sure you would like to save a couple of dollars on your ticket if you can, the way the Gas prices are, why not try and save as much money as we can these days.. give him a sweeter deal than the one that he's looking for. this may cost you but in the long run its worth it. answer::::: give him what he wants. if he wants to be heard by the cops give him to them. everytime he makes a seen either by the legal or illlegal means, call the the cops. they will get tierd of him and you, and the next thing you know he'll be gone by legal or illegal means. you pay your taxes (right)!!!!! use some of what you pay . take control of your political right!! it cost you patience. good luck

Post a "no loitering" sign and then call the cops again. This time ask them if they can take him to adult services. He needs a shrink.

Call the city dump to have him removed.
Use bread crumbs that lead to a cliff, and hope he falls for it.

Ask him if he is thirsty and provide him with water if he is. Given his insult to Christians, perhaps you should go over and preach the Gospel to him.

you can have him legally retainted from your bussiniss get a order saying you have to x amout of feet away frowm here. get the police invole.
