Why is Sadam Hussiens AIDES ( underlings ) being charged, If they where OBEYING ORDERS.
Look at ENGLAND an OFFICER in the AIR FORCE refuses to go because he believes the war is ILLEGAL
What do they do put him in jail for DISOBEYING an order
Good job the law stopped them from SHOOTING him.
In Iraq you could be shot for disobeying an order
So if they where obeying orders how can you prosecute them for war CRIMES

So what the English are saying is
If you disobey an order refuse to go and fight,
Possibly kill others in the war.
YOU WILL BE COURT MARTIALED
So obey ORDERS thats ok no
charges or sentence
you are a GOOD SOLDIER
you OBEY ORDERS.
nothing will happen to you
Sadam Hussein gives orders they are OBEYED
they are BAD SOLDIERS
Now they face the DEATH PENALTY for OBEYING ORDERS

My SON is in the BRITISH ARMY
If he felt it was an illegal and imoral war
and did not want to go then believe he should have the right to say so
This war is unjust and ilegal

I ASKED what is the DIFFERENCE BETWEEN bush etcetc
I notice people seem to want to compare them, By what they say.

Also I am proud MY SON is serving his Country and doing his DUTY
I served in the forces and obeyed orders.
My nephew Served and fought in the 1st gulf.ETC ETC
My son has served in Ireland, Bosnia Germany ETC ETC without question


I said I would support HIM
Not the BUSH?BLAIRE regime.

Basically there is a very important and simple answer. It is no excuse in international law to say that you were obeying orders.

If obeying orders were an excuse there would be no justification for punishing somebody who released the cannister in the gas chamber of an extermination camp because Hitler or whoever was the leader told him (or her) to. Nobody would accept that.

Officers such as the Air Force doctor you refer to recognise this and feel placed in a very awkward position. They can only hope that a Human Rights court will get them off in the end, but of course they're suffering greatly on the way. As you say, if you are in a regime that has the death penalty the situation is even worse.

I am not going to express an opinion in this response as to whether or not the current deployment of British military forces in Iraq is illegal.

I am sorry that if you have a son in Iraq this response may be cold comfort for you. I live in an English town with a barracks and know how concerned and worried the relatives of soldiers in Iraq feel. My thoughts are with you.

What do you want answering? Seems like you just have issues you wanna get off your chest and point the finger at somebody!

When your son enlisted into the British Army he recited an oath that states you will do your duty and obey your Orders. This is a contract - much the same as a mobile phone contract or your mortgage. You break any contract there is always small print.

Your son joined the Army to defend his country, to fight wars, and to follow Orders - If everyone in the army had the right to choose whether to go to war or not, they wouldn't go, and there would be no point having an Army. Think it through - your question is more of a one person battle engulfed by media enlightenment.

You put Hitler & Napoleon in the same catagory as Bush and Blair - you have a lot of work to read up on - And try to read more than just a tabloid newspaper!

If u wanna join the army then fair play cos we do need an army but I think that it takes a certain type of person, ie someone who enjoys it. I would never join the army in the normal course of things.
If however the muslims, for instance, were a serious threat to our country/way of life, eg threatening to make our women wear veils etc then I would fight to the death, but if u think that u can sign up and pick and choose which fights to participate in then u are terribly naeieve (if thats right spelling).
Thumbs up to the boys who risk their lives and those that give theirs, but please dont try to be politicians too, cos uve taken the wrong route to have any say in it.
And as far as bush & blair (i think u meant) are concerned then dont u think that they would be hung drawn and quartered if the iraqis were in charge? In fact there was talk of puttin em in jail anyway, using our own legal processes for war crimes. And what about the soldiers who get arrested for their crimes against the locals? I know that they done wrong and hence we punish em but they are all there to kill aint they? I cannot believe that the oppostion would be arresting their own no matter what they did to us.
Please dont talk about illegal and immoral wars when no-one has attempted to invade england since hitler, and our invasion or remote atttack is the only real justification for a war.

Interesting Topic,

kinda got to remember the war with Iraq/Saddam is long since over, its a new war, and maybe this one is worth winning.

The first war maybe not so just.

This is interesting because its long been a problem with armies and orders.

Basically what you are saying is that only the person giving orders is responsible for these crimes (true) So all sub-ordinates will say they are just following orders, and not get punished.

People like Saddam will claim they are not involved in the field operations of their armies (also true)

So now no one is guilty, and its a free license to commit war crimes.

Your son does have the wrong to say it is an immoral war, and be a conscience objector. The guy you are refering too did not do that, he wanted the fight over the legality of the war, and of course he lost for not obeying orders (he did not have to start the fight, he would have been discharged)

Everyone in Iraq committed crimes against humanity, from Saddam to his sons, generals, and a lot more because they could. A lot of the day to day rounding up of trouble makers, how much input do you think Saddam really had? thats too low for him to deal with, i would be surprised if he was even informed.

Anyone who joins has to go to war if ordered. If someone is given an illegal order that is different. As in the orders Hussein and Hitler gave to slaughter innocent civilians. As far as i can tell Bush hasnt given any orders for mass killings. To follow such orders is murder, as you are protected from following immoral or illegal orders, and are liable if you do follow them. True innocent civilians are being killed in the war, but that is mostly by terrorists, some of which are their own people.

How can u put Adolf Hitler in with bush blair and Nepolean?
If he thought that war was illegal he should not have joined the military. I'm joining up and i know i'm going to be asked to do things i don't want to by my government, but our government is the only reason our Country is as great as it is so i'll suck it up and put it behind me.

its all down to personal responsiblty,and the western world has shifted it to someone else,it matters not if the war is just or otherwise,what matters is the soldiers are easy targets,win the hearts and minds,of the enemy,and of course steal there oil as well, now theres a laugh
