if you are trying to pay a a debt that is in collections will they sue you. just got the letter yesterday about it being in collectons. they called and said tomorrow they will make a decsion on what to do if i do not pay. i am worried they will sue me rightt know (today know)while i am trying to go threw cccs which made a payment with american express today. also the letter wants me to send the money not to the collection agency but to american express Who has my account i am confuesed and scared???

HI ALL thanks for the answers. I am really scared(or was untill I read some of your comments) The CA called today and she told me they would put a hold on my social security. Then I asked who owned my account and she said it did not matter that They would not take CCCS that it was declined. I told them that the CCCS had not got a decline and she said American Express never takes CCCS programs. She said I should cash in my life insurance and aunch of other things till i was in tears. If me telling her that I made a payment to American express threw CCCS. She said I was wasting her time I must not have any thing better to do. ETC ETC some things I thought are lies. She did say that American Express would sue no they are going to. I am so confused she put me on hold and i hung up. I guess I am worried they will sue before CCCS will get a accptence letter from them but I have made a payment with them. Hope Amer Ex takes it. Thanks again I really do not know what to do about the lady at CA

dont worry yet. they will work with you to get paid. so you can set up payments with them on a bi-weekly, weekly, monthly basis. Just set up an automatic payment if you can for whatever you can afford. you are a little ways from being sued.....dont worry......you still have time, just get it taken care of.

First of all, don't be scared, thats what they want. A debt collector must follow Federal and state law and because of harassing methods used by debt collectors, laws had to be passed to make it much fairer to the person owing the debt.
If CCCS has made a payment to American Express, this means they have reached an agreement with them to get your debt paid off and there should be no calls or letters made/sent to you by American Express and also, American Express will be unable to win a law suit.
Call CCCS right away and tell them what is going on and they will advise you. If American Express calls again, just tell them that CCCS is handling this account and a payment was already sent. If they try to bully you, that is illegal, hang up on them.
Addition: For all the other people answering who are unaware of what CCCS is, it is not a collection agency. CCCS provides credit counseling and/or debt management to assist a person who has debt or collection agency problems..

They can take you to court if you refuse to pay, no fruad need be committed, the court case will take months not years... Mine was opened and closed within 6 months. You do NOT want to go through that trust me!
From what you have said above, I would suggest you do what nikki suggested. Call the CC compnay talk to the collections department and make arrangements with them how to pay off the debt. Once you have made those arrangements, the collection agency should leave you alone.
Collection agency's LOVE to scare you to death, they do not tell you your rights, they mislead you, and sometimes they even break the law in so doing... Do not freak out about this yet. Talk to your CC asap and deal with the problem at the source.

Most debts are paid legally to the original debtor.
The collection agency acts as a agent for the company.
They usually get a percentage of the amount they collect.
Credit card court actions take years and they can only
file if intentional fraud was committed on the account.

Most companies will work with you if you show intent to pay. Their ultimate goal is collection not destroying you. So, I would advise you to call the company's receivable/collection department (part of accounting) and explain your situation as well as your desire to pay. Then ask to work out a payment system that's doable for you.

do you have any assets for them to sue you? my friend's lawyer said if you don't they can't touch you....dump the letter. for me when i had to pay debt, my account was with the collection agency so $$ was payable to them.
