The court system is not properly set up just yet. They still have work to do in setting up a government first. Yes,it will hurt relations with the government especially the people who were just learning to trust the military despite the Abu Graib incident.
Those soldiers will face American military justice and I can tell you that they WILL face the death penalty. And to answer your question,NO,the military will not turn over American personnel to Iraqi justice.

If the local law is within the realm of the punishment if any that is due in the military or america, local jurisdiction should take place. By this I mean if the punishment is "cutting off the hand for theft", then the UCMJ (military) should take precedence. In the case here, rape and murder, then local law should take precedence, however evidence should be up to the standards of the military and America

Lets turn the question around. If a foreign national raped and killed a member of your family would you want him/her to be sent home to their own country for trial? It is only right... The alleged offense happened in Iraq, and even by our laws the trial for an offense should be tried in the same area as the offense... The UCMJ does apply in this situation, but so does international laws and treaties that were, or are made between the USA and other nations.

I am seriously offended by the comment from Gagger. How can a little girl be asking for getting raped. How dare you say something like this. You need some very serious counseling. I was horrified when I heard about the rape. I thought our soldiers were better than this, I thought people in our military are suppose to be in "good moral standing." Now I see our soldiers differently. I hope the soldiers involved in this burn in hell.

First of all... what they did was barbaric and disgusting. Reminds me of some famous Arabs on 9/11.... however, since they were in US command/custody... US law applies. Having said that - Kansas sucks and death (which is probably their fate) is about as just as you can get. I don't see how giving them to Iraq (or Iraqi jails/punishment) would be worse than what they already face. (let's hope)

it wont matter, the miltary does things differently and they will never see the light of day again either way.
but if it was up to me id say, offer them in exchange for the terrorists who beheaded or soldiers as a good will gesture. that is the type of behavior we are fighting against, it doesnt matter to me who commits the acts.
problem is this... iraqis feel that everyone is somehow beneath them and if their people die its a tragedy, but when our civilians die it serves them right for voting for our government. they even partied in the streets to the sight of people jumping to their deaths.
now they want us to leave iraq, but they provide safe harbor for those who kill and maim our innocent civilians so screw 'em. let them get a good solid taste of this **** and see if they still feel the same about all those women and children who died and ground zero.

first of all to jack f. you are stupid thats all i have to say to you. second to gagger you are really stupid. no one asks to be raped. 3rd, they should all be put to death i think the iraqis should kill them the way they did those people. i am going through a divorce with one of soldiers and have been for 2 years. i have 2 kids by him. and personally hes always been a scum bag and always will be. i would rather tell my kids he died in iraq then he went to prison for being a rapist murderer.

They had absolutely NO business and NO right to touch that girl and her family!
Those soldiers have made it hard to maintain any kind of peace-keeping in Iraq.
AND...the sad part is this; the deaths WILL BE avenged OVER and OVER and OVER and OVER again!
We are not going to be able to count the heads that are goinng to roll!
So...I say...bring an end to the madness and turn the criminals over to Iraq TODAY!
More US soldiers are going to be kidnapped and tortured just because.
I had hoped that no one in one of our uniforms would stoop to that kind of low-level/animalistic behavior, but...I'm not surprised!

it is a crime committed locally, against local people, so local law should prevail... soldiers think they are under military law in a war situation and count on getting leniency because of that, whihc should not be allowed...
