i let my little brother borrow my car and he wanted to impress a girl so he let her borrow it. she didn't have a licence. she totaled my car and hit someone elses. she also hit two people, they're ok. my brother said he would pay for all the damages but i think she should pay for some damages too. should i pursue the matter in court or just be happy that everything is being taken care of already?

If your brother doesn't want to make her pay, and is willing to take responsibility, let him. It's his loss and his lesson to learn.

I would strongly follow though with sueing the Girlfriend. If your brother has "difficulties" with paying, what then? I would suggest going thru the proper channels, else you may be left to foot the bill, and this WILL cause endless drama within your family.
She DROVE...
WITHOUT a licence!!!
She IS responsible. Ignore the emotional blackmail. She made her decision, why should you be the one to take the risk, financially.
You could also have her sign an agreement, that she repair (pay for the car) and have it legally drawn up out of court, so there is no legal issue about her driving unlicenced..
This is not a pretty situation but it is NOT your fault, it is not your brothers fault. IT IS HER FAULT. She is the one who must pay.

As Dale.P says above... There is the STRONG possibility of "legal action coming your way".
With this in mind YOU HAVE NO ALTERNATIVE, but to sue the girlfriend.

Just make sure your butt is covered legally. It was your car that was involved. Assuming you have insurance, that makes you a target. Be more concerned about lawsuits coming your way, then whether you can take her to court. If they do come your way, you're going to need a lawyer and let him decide what to do about the driver. Don't play your cards too soon in these circumstances. People can come back and claim injuries that can drag on for years. Don't settle anything until you know the full scope of the issues.

Note: Your brother could be held negligently responsible if he let her drive knowing she didn't have a license.

You have nothing to do with that girl, only with your brother. Yes of course he lost your trust and should pay for the damages. I hope you have learnt a lesson if it comes to your brother. Whether he claims from that girl is not your business and irrelevant!

sure, they do if it extremely is something that interests them. i'm efficient if the guy loved procuring, he'd be drawn to that, too. it easily relies upon on what the guy is into. For me, i recognize autos and football, so any woman who's into autos and football definately has an benefit over someone who's purely "extremely" without interests except procuring.

Are you for real? What state do you live in?? The cops would have kept your car & you , your brother & the jail-bait would be sued for anything you have or will ever have. She nor the vehicle should have ever been on the road, period.....!!!

both of them need to take responsibility for this mess, i glad
that no was hurt but they need to understand the rules of the
games. she need to know as well the problems that come
from not taking serious the actions.

damn----i think the FIRST think i would do is hire a lawyer. this has the potential to get VERY stinky VERY quickly!
