I bought my husband a tennis racket in a sporting goods store today - it wasn't in stock yet so I prepaid for it with my credit card and said I would pick it up tomorrow. When I got home my husband told me he didn't want the racket - the store has signs all over the place that said "Returns are for store credit only" but if I didn't actually take the racket home can I ask the store owner to refund my credit card? Help! It's $300 - it was for his birthday and I can't afford to lose that money.
Any answers would be greatly appreciated.

Effectively, this would still be a return, so the store's policy applies.

But talk to a manager or the owner - you may find a sympathetic ear. Most retail managers/owners don't want to lose a future customer over these types of events.

If all else fails, you can try a chargeback with your credit card company - you would approach this as a disputed transaction. See the back of your credit card statement for how to do this.

But you don't want to be completely open in your description of events if you opt to pursue this approach.

Technically, you bought it. Just because you are going back to the store to pick it up does not mean you don't own it. On the other hand, technically, the store could not sell something it did not own or have for sale, it in effect sold you a promise to deliver it to you.

If the policy on returns is as stated, with no exception for return of defective merchandise, it is illegal in most states. You have no guarantee that the racket will not be defective when and as delivered, so I would call the credit card company and tell them to reverse the charge because of the illegal refund policy, which voids the warranties of fitness for a particular purpose and of merchantability.

You do have a point. But the best thing to do is ask the store manager or research the store's policy on refunds. In some cases, it's at the discretion of the management.

Don't pick up the racket. If you don't pick it up, it hasnt left the store and it's not in your possession.
Call your credit card company and explain it. Tell them you dispute the charge. The credit card company should remove it.

"can I ask the store owner to refund my credit card?" You *can* ask the store owner to fly you to the moon, but it doesn't mean he will. It can't hurt to ask. Put it in terms of cancelling the transaction rather than asking for a refund. Before you do it, call your cc company to see if they have any protection if the store manager/owner says no.
