she is afraid of her home and her father she is miss treated not provided for and is 9 she also shares a room with her 10 year old brother and has no type of privacy when doing girl things

State law governs family law matters. You can check the code where your sister lives to see what you must do to get custody. You may need an attorney to file a complaint in family court. You may also want to check with Child Protective Services. If they remove your sister from her home they may look to you to take custody of her. Hope that helps.

How old are YOU? What state is this in? Where is your mother?

If you believe your sister is being mistreated, you should report it to the child protection agency for the state she lives in. The agency may find she is being abused, but also may find you are not a proper foster parent, and put her in another foster home. Will that make her situation better?

Otherwise, you can go to court and try to prove your father is an unfit parent, but again, the judge does not have to place your sister with you. What evidence do you have of any mistreatment? What can you offer to prove you are a capable parent substitute?

Years ago in this country (and in a few places still) and even today in most of the world, whole families live in one room and no one has any privacy. That alone is not mistreatment.
