I think it depends on the state in which the motorist is operating the vehichle however in most states, there is a point where the line demarking the bike lane becomes a dashed line. Generally, motorists can enter a bike lane to make a right turn after this point.

If there is no other traffic in front of you making the same right hand turn and you are not blocking the flow of traffic, you should move into that lane at the broken (dashed) lines.

Only when there's a biker in it that's been slowing down traffic for at least 6 minutes.
