he mom is okay with giving her to me she is not able to take of both of the kids so i am willing to get my niece to provide a better life for her and lawyer sometimes can be ugly and it is not that she is unfit but at this time it is hard on her so i am willing to help but i need to get the paperwork for her to sign but i do not want to go through a lawyer so what can i do

if it is a mutual agreement you need to get guardianship papers and both you and her need to fill it out and read over the whole thing then it needs to be notarized, if the father of the child is around he needs to sign them as well. once that is done it will be alot easier to adopt without a lawyer. you can even call the courthouse and see if there is a way to do this throught the court, if its mutual you will not need a lawyer.

This is a sad situation.

If you can't afford a lawyer, how are you going to afford to raise a child, buy her clothes, educate her, send her to college?

I know you must love her, and that she is family. You can hire a paralegal to print out the papers for transfer guardianship for not much money. I think, but am not sure, that you can have a power of attorney made out so you an make decisions for the child. I would suggest doing an Internet search on these things. You can just take are of the child, and have the mother sign the important things.

Depending on your states laws you may be able to go straight to the courthouse with the mom and do all of the paperwork and pay the fees then. She may have to be the one to do it, but as long as she's willing to sign I would think that if your state does it that way it would be cheapest and easiest!! Good Luck!!

If you, the neice, and the niece's mother all live in
the same state, and all three parties are in agreement
with this situation, then you should be able to file the paperwork
yourself.

go to www.findlaw.com and download the forms and read
the paperwork for your area's laws.

you will be filing paperwork with the
clerk of court, possibly the one specifically for family court.

Ask the mother to write down that she give you permission and sign it. Show it to the clerk down at family court ,get the papers for custody,adoption and also the waiver for court cost . make copies to be deliver to the mother from a party not relative to the case. then wait until the court hearing.

She can sign her daughter over to you but I think you have to have a lawyer and it has to be done through the courts.

you can always look for a Pro Bono lawyer, which means they do it for free....but check it out with your local Social Services department, because they'll be able to give you the best advice and tell you what not to do!

You have to go through the court system to have custody turned over to you...there is no getting around it.

I am not sure of how things work in your state but your Mom might start by calling the probate office in your town or county
