The car was driven for 5 days. then it was taken back to the dealer because it had problems. and it has being in the shop ever since. sale date was 6/3 and the dealter is still fixing it to this day

Most states have lemon laws to protect people from such problems. It certainly sounds like you have suffered enough, and you should be able to take action against this dealer. Check out the website below for details about used cars in your state.

Most states have a law regulating sales. I would, however, guess that you are over the cancellation limit with five days. If the dealer is unable to deliver it to you by now, he probably has a poor case to make you respect the sale, unless he has had you in a free loaner all of this time. I would just go in and tell the sales manager that you are going to refuse delivery, and that you are willing to defind yourself in court if need be. Good luck!

Lemmon laws ONLY apply to brand new vehicles. Don't waste your time with that. Most states give you 3 day right of recision on used car purchases however you went over that. You may be able to talk the dealer out of it however you are likely stuck with the car. They are not legally obligated to let you out of it. That is why it is so crucial to take a used car to a good mechanic to have checked out before you sign the dotted line. I wish I could give you better news.

I don't know if it applys to used cars, but dont we have lemon laws. Perhaps you can talk to a lawyer. I think some will answer a simple question over the phone for free.

go to them an tell them that the contract is not working with you cuz you dont want to keep bring a car that is not working every minute to the shop so tyhat you just want out of the contract till you fine somthing new be truthful
