IF Mary was given a choice to be the mother of jesus then no he isn't a rapist, but if she was just TOLD she was being made pregnant and given no choice then yes he is a rapist.

Uh, excuse me for bothering you with the facts, but ... yes, she did. She did know, ahead of time, that she would become pregnant with Jesus.
That's because God sent the angel Gabriel to announce it to her, and it didn't happen until Mary gave her full consent.

As I understand the Christain faith - Mary had already "given herself" to her god in devotion of her life and belief. He, being able to know she meant it, proceeded with that permission.
