I don't know how the law is in Fl. but I can tell you here in this state if the parents split up, the mom can get the child support from dad. It don't make any difference if they were married or not. She can go file against him for child support and get it. It will go back from the day they split up to present as for the back child support. It don't start from the day she filed, it starts the day they split up. If he don't think it is his, he can get a DNA test done, if it is his, he pays for the test. He will pay the support on that child from the day they split up and until the day the that child turns 18, (it is 18 for here, don't know about other states). Also once she gets judgment against him to pay the support, should he not pay it, he looses any and all his licenses that he has and/or go to jail for 6 months. That is the way it is here in this state, don't know about the rest of the states. Around here, we don't like dead beat parents. That parent being either the mom or the dad.

He only has to pay back to the date she filed for support. Also he has to have acknowledged that he is the biological father of the child. IF he never did he will be asked to take a DNA test for proof.
