She fled the scene. I was rear ended at a red light she had no intention of stopping at. My dogs flew from the back seat to the dashboard, I followed her called 911 and she was arrested. It turns out it was her 3rd arrest for drunk driving, she was conviicted of drunk driving and felonious assault. I was in bed for two months, had to hire someone to take care of the house,because I was in so much pain. I'm trying to get damages from her insurance for $10,000. (roughly what my bills were) They want to settle at $4400.00 and I'm being told I should settle. WTF? I'm not asking for the moon, I think given the circumstances I'm being very reasonable - everyone who saw me during that time frame were licking their chops over how much I was going to get!!! (Like looking for $500,000 or 1,000,000) What do you think is reasonable and should I get another lawyer?

to xtowgrunt: yes by the laws of physics the dogs should have gone back, but there was no back to go to. So the immediate impact (and remember this happened in literally a second) flush against the seat and then flying towards the front. I had my seat belt on and I flew forward too!

Her insurance is required to pay up to the maximum allowable per her policy. What they are most likely saying is that $4400 is all that is left in that fund. You could go after her in a civil suit, but odds are you wouldn't see much money being as she is probably going to jail for a few years. Odd, though, reading your description raises a question. You said she rear ended you causing your dog to fly from the rear seat to the dashboard. In a rear end collision of stopped vehicle, unsecured objects in your vehicle would go rearward not forward.

I think the story needs to be told so people can understand the question, I would get another lawyer. I got a lot more than that, with less suffering than you seem to be going through. You will suffer in the future too these things don't magically go away once you receive a payout. Good Luck

If you were rilly that messed up, I'd say go for the $10,000--or even more (within reason). Maybe $12,000 to include pain and suffering. You at least want to cover your doctor's bills.

dont u have a lawyer? if u do its time to look for a new one. NEVER settle for less than ur bills.

Yes get another lawyer. I don't know how bad you were hurt, but what they offer you is crazy. Don't settle for that!!!!

get advice at least from another lawyer. i don't know about a million, but you should at least get repaid for the damages.
