If it is written down in a contract........
He has to follow whatever is written on a contract, otherwise he is breaking that contract.
He has to replace them at his cost........
I would phone your local Better Business Bureau..........
He sounds like an idiot,by the way!
I really hope you researched your contractor.......
I own my own business and have to deal with contractors all the time..........and I only go with ones I know and trust!
I wish you the best.

Tell him to finish job and refit the old cabinets and do not pay and then he will have to take you to court to get his money back. But you have the contract in writing so it is his problem .Also a good idea before and after photos .So when work starts on a job like this you have proof that the of what you want the finish job to look like and what items should have being lefted alone.

if you had it written into the contract that they were to be kept, it should be his responsiblity. They should replace them... Do you have proof that you wanted them kept in?
If you didn't have proof you may have a problem.... It may come back to you to replace them...
Regardless-I would suggest that you not pay him to install the new ones. He could be a little crooked, and simply be trying to get some extra money out of you.... Do you trust him to do it right? Has he got all the needed permits etc? Do you have other options?

Everything should be in writing. I am a contractor and I will not start a job until it is completely defined in writing and signed off by me and my customer. If there is complicated work, like installing a Kitchen, I include detailed drawings that we both initial and get copies of. That way, there's no misunderstandings.

Gee, that sucks. I can just bet that you are alone or that at least there is no man in the house and that the contractor knows this so he did it on purpose so that now he thinks he's gonna make more money installing the new cab.s, or he just didn't listen and/or care or take you seriously because he thinks that with a single woman he can float off into La-La land while you are talking cause he thinks you will acquiesse (sp) and pay, or that you don't want to bother to go to court or stand up and confront . . . I got plenty of this sh*t when I owned a house by myself. I was in my 20's and even had an old biddy lady who resented me (she was very blue-collar at best) and would stand outside and try to beat me to my workers before they even went to the door . . and she would tell them things like that I'm 'dingy' or anything to let them know that 1. I'm alone 2. That she would side with them if there is any court action. She was an original owner since the houses were built, . . . and she created problems for two owners and their families back . . before me. . .maybe more . . she had the dirt on EVERYONE in the neighborhood and would share it with anyone, cause she shared it with me when I first got there, . . then before you know it she was I think talking about me, . . .and still talking to me about someone she was later friends with. . .Just be glad you don't have this sh*t to deal with. It's like she resented me for ever getting any work done. . .she even resented me for going outside too much. She used to come over in the mornings and try to wake me up (cause she didn't know I slept at my night job) she'd make up anything to have a reason to come over . . often using the same reason . . .your car in the driveway started by itself . . .It was just the fan . . .I told her this like three times.

from what I understand he should pay for the cabinets, however you won't be able to get re imbursed for the full cost of the cabinets, just the value of the old cabinets, at least in a court of law

well Jenifer, if it you and him only in the chat and no one else and you have no way to prove it what does it tell you?
stinks doesn't it!! he got ya! you got to pay for it if he is going to wright it off as you wanted it gone. But if he truely knows now it was a mistake and feels bad about it he would pay to replace it I know I would if he does not you have to pay but I think that is bad business and I would tell everyone I know that want work done like that to run like hell if he comes knocking for work

If you have this in writing then I think a smalls claims court would back you up.
