To answer this question in full, I would need the following information:
1) Have you printed off the details of the original bag?
2) Has the seller admitted to you that the wrong one was sent? (as you no longer have the wrong one to prove this)(If so print this off too).
These are the most important points.
3) Did the seller offer a refund if you returned it? (again print this)
4) Did you get proof of postage, and has the seller acknowledged the return?
Provided you can prove that the wrong item was sent and that the seller has neither provided a refund or provided the correct item then the seller can be prosecuted for Obtaining Money By Deception. The police will ask you for proof, as described above, to support their case. If you know any details of the seller provide these too. The most likely outcome is that the seller will be fined and possibly made to compensate you. If they have defrauded others and this comes to light then possibly Community Service could be ordered. Prison is occasionally an option in these cases, but I am aware of a recent case involving many thousands of pounds in which the sentence was a relatively low number of Community Service hours.

Was this bag from abroad? I know a lot of bags are sold on e-bay from abroad where they charge extortionate postage. E- bay will try to take action against them by banning them if it is fraud but if it is from abroad our police will have no powers. It is always best to pay by credit card if possible as they cover you or paypal in which case if it was fraud you would get your money back. You could ring trading standards if it was a business but if it was an individual doubtful but worth a try. You could enter a dispute if 7 days have lapsed and e-bay will step in. Have you contacted the buyer e-bay will give you their telephone number if you contact them in these circumstances.

the police wont do anything, unless there are a few cases dealing with one user, i also read some of your answers regarding why u didnt use PAYPAL !!!. paypal are another section of ebay who run a very poor service or i should say are as corrupt as a 25 pound note, ebay and paypal need to be reviewed by uk bank standards as they are extremely well off with their immense fees and account freezing actions (freezing funds in an account for upto 6 months, you wait this long they release the funds and who gets the 6 months interest money....they do). there are numerous other slightly more safer options for online paying. avoid paypal like the plague.

I dont no about that but you should have cancelled the cheque as soon as you noticed that the bag was different but you can also see if the person has cashed the cheque and if not cancel it as soon as possible

No, this is a civil matter in general and would result in a law suit.
Did you contact the seller prior to sending it back, do you have proof ( reciept) you sent it back, was returns allowed or accepted.

did u pay with paypal? make a report with them if u did. u'll get your money back that way. (i did)
if you didn't chalk it up to exp. and always pay with paypal at eBay. The paypal acct. is free for buyers and very secure.

I doubt if the police will do anything , unless its fraud on a major scale ... e-bay should deal with it.
Its your own fault, NEVER PAY BY CHECK.
