If they make it to dry land, they can stay. If caught still at sea they are sent back. Should we really be determining immigration based on the luck of the immigrant? Shouldn't we process them in a more logical manner? Or at least look at the merits of each entry? I obviously think its bad policy. What if we catch the guy who's escaping Cuba with the keys to the missles and the crazy would-be lunatic makes it to dry land ? Is this just organizational laziness on our governments part?

I'm going to add in response to 1st answer....If not under our laws, then how are we justified in stopping their boat at sea. I would think they would be under our jurisdiction in our territorial water( i.e. the border doesnt start at the beach, but living here in the middle of desert with an ocean at least 4 hours away, i'm not sure of how far out we can go). Secondly, if on dry land, and here without permission of the US, wouldnt we be justified in deporting them like we do when we catch mexicans hopping over the fence?
Lastly, my question tonight was indeed prompted by todays news story, but it wasnt a pregnant woman who died. It was a woman, and another woman who is pregnant was injured,but she'll be okay.
