I am in Los Angeles county. Some guy attacked my girl friend so I put my self in between him & my girl friend. He grabed me & started to hit me I punched him in the nose. Then the fight was over. He went to the hospital for a broken nose & I got my probation violated. The judge did not even give me a chance to tell her my case. She gave me a year in jail. But she did say that I would probebly only a couple of months due to the Los Angeles county jail overcrowding problen. I was wondering if there was any truth to this.
And Please if your are going to be a jerk dont respond. I got enough problems

I am not a violent person I just know how to defend myself. I own a business I dont drink or do drugs. I am going to loose every thing because of this. If I will only do a couple of weeks I would be ok with this. But any longer it's just not fair. Where is the justice???

The jails here are very over crowded & my lawyer said I probebly wont do that much time. But I am just realy scared. In hind sight I should have gotten out of there at the moment things got heated but how was I supposed to know things would get violent.

Being on probation is why the Judge didn't listen to you. And I am not being a "jerk" just stating the obvious. Breaking a person's nose is a crime not matter why you did it.
You got your probation revoked because you violated the rules of staying out of trouble while on probation. So it doesn't take a rocket scientist here to understand this.
But I will tell you that a "year" does not translate to 12 months. county time is done in months, hence you can receive 2 for 1 in some county jails. If the judge said "a year" then you should have been transferred to a prison. But even then you will do considerable less time depending on the original offense.
More than likely you are serving the remainder of whatever time that was left on your probation plus the new crime.

Your question makes more sense with the background information. You could probably get a reduced sentence with a strict probation.
Breaking someone's nose is assault. No doubt about that.
Here's a tip. If you are on probation, and know that if you as much as sneeze without covering your nose that you will get sent back, don't go to places or hang around with people that may attack you or your girlfriend.

fighting in public is illegal and if you were already on probation and you were fighting then yes you may have more problems than you realize. thats the truth mantypically county jails give you 10 kinds of time served credits and overcrowding will speed things along. it sucks man but you have to be smarter than you have been. if you had tried to run and got punched in the back of the head you probably wouldnt be in this situation.

Well I'm not completly familar with California law, but in my state if you are sentenced to 365 days or less then you have to serve the ENTIRE year in county jail, not a day less. But if given 366 days or more you go to state prison, but will probably be out with in a month or two. But if the judge told you you'd be out in a couple months, you probably will. Well, I'm not from LA, but if it is for violation, that usually means you will do the whole scentence, but due to overcrowding, I have no idea. I would absolutly appeal it and hire an attorney to get the judge to listen to your story. Did you or your girl file charges on the guy?

if its a first violation you will probably end up in there for about 45 days before they kick you out.
one piece of advice never take probation always just do the time once they have you on probation they own you for a long time to come, even being stopped by the police can violate your probation in some places.

1st time + good behavior = 1/2 time sentanced
On probation and have a good sympathetic female public defender + good behavior + time served = maybe 2/3to 1/2

8 mo. 20 days on a 16 month sentence and thats your first violation 2 or 3 or even 5 on continuous violations.

Clearly your problem is where you live. Most likely you had a leftest liberal judge who considered (some guy) as the REAL victim. My advice ?, move to a more conservative area. Where the Law would represent YOU instead of the attacker. Vote Republican

There are too many judges like that. If I had been the judge I would have listened to your side of the story. If you lived here you would get no time,but maybe a warning to try to avoid these things.
