You can go to the aspca website and download a document which describes your rights, depending on what state you live in. First, see if you can settle this with the pet store - lawyers usually charge 30% of whatever you win.
You might do better in small claims court without a lawyer. Make sure you have plenty of documentation - receipt from pet store, vet's bills and record stating exactly what tests were done and what is wrong with the pup and WHY this is the pet store's fault.

Is the pet really sick, or did the vet that they sent you to for the "free vet check" tell you the pet was sick?
Here's our story with "Wisdom":
We wanted an orange and white kitten for our one year anniversary and found one in a pet store. We took him home to our small one bedroom apartment. My exfiance had an "office" in the bedroom, so we slept in the living room. We'd open the closet door to keep the cats out of our sleeping area. Wisdom (who became known as "Wizzy") climbed up on my winter coat and jumped over the door to come sleep with the people.
Next day, we took this active kitten to the vet for this "free" check. I wanted this critter declawed, as he was already going to town on my winter coat and various other things. (I will block and/or report anyone who questions my judgment on declawing cats who live in an apartment/condo situation. I don't want to know what this place would look like if I had cats with claws) The vet said this cat was "very sick" and needed all sorts of antibiotics and couldn't be declawed as "sick" as he was.
I called my vet (who fixed my 16 year old cat when he was a kitten) and she not only declawed my 4 month old kitten that night but she also neutered him. Told me sick kittens don't jump over closet doors.
So...make sure your pet is actually sick. (It might be obvious in your case though. I can't tell from here)

Try reporting it to the ASPCA and then follow up soon to see if they have been shut down, if not call the police to help. There should be a local ASPCA in your state.
Don't know about a lawyer.

The best place to start is contacting your local ASPCA or SPCA. These organizations have thier own law enforcement and will handle each case, depending on their findings and investigation.

Call the city Attorney, she or he can reccomend one. Or just try to shut them down youeself, humane society, the vet's office, they can help you with these kinds of complaints.

Call your state's attorney general office. They could be committing fraud and that is the best agency to handle this type of matter.
