To my knowledge, restaurants do not pay to be listed in Zagat's. The guide is based on surveys filled out by actual diners. I have done so in the past. Which restaurant are you referring to? That may help us answer.

Falls below a certain level of dining.....or they don't pay to be listed.

If it's new, it has a legit reason for not being there (i.e. opened after publication); ohterwise, I would be suspicious.
