You get a DUI one night with a .1 BAC. The next day you get pulled over again and they give you a breathalizer...you blow a .09. Can they give you another ticket for DUI just because it hasn't left your body yet?

You did sleep it off. Alcohol stays in your system for 24 hours so you would have the same BAC the next day without drinking anymore...and you wouldn't be drunk.

And it's still legal to drive...they give you a temporary license until your court date and the official ruling.

I believe when you get arrested for DUI then you are legally not allowed to drive till you're below the legal amount. A second charge could be considered bail jumping. And whom ever signed you out of jail the night before could get a ticket also for allowing you to drive.

yeah i guess because you got behind the wheel while still legally drunk.

Also you must be the worst driver or have horrible luck to get pulled over twice in a 24 hour period.

You should have your car taken away. I can't stand drunk drivers. In fact, I called 911 last week and reported one as I was riding home.

Yes you can. You are still over the limit. Check your state law's. I know wome one that this did happen to. Thay didn't know about the one the night befor. So he got out of one of them.

yes, why didn't you stop driving after the first one? it is illegal to drive when you are above the legal limit of intoxification, no matter how many times you do it in the same day.

Yes....if you drive with a hangover you are probably still legally drunk.
