You made the robot, BRAVO! And you gave him free will, that's a double bravo. But you didn't give him any guidelines to follow, or an eternal soul. He has no conscious.
If he had a soul and knew about the consequences of his actions then it would be his fault for killing another.

Neither of you is off the hook.
You go to jail because the robot hasn't got human status and just goes to the junkyard. Lawyers can't make anything from it, but can from you. It will take a while for any justice system to be able to understand freewill as it applies to robots.
Ethically, I believe you are not responsible if society recognizes robots with freewill as equal to humans with rights and responsibilities.

since i am a gun owner, drive a vehicle and have a drink and a cigar now and then, i have to hold the individual that does the deed, not the maker of the gun, car, alcohol or tobacco.
however, i believe the creator of the robot would be at fault for the deed, if there were no failsafes put in to prevent the act.
i am a Christian, but if i did not have free will, i would not ever break, or even think about breaking the rules so fault can be put on God to some point, however, since we know better, then it falls back on us.

First of all that is impossible.
Second it was the robots choice you had no part in this, nor did you program him to hurt people. So the Robot is at blame.
