He needs his work permit and everything, he hasn't even started the process. We live in NY state and I need to know what immigration is going to check, income, ect? Help!

call INS and ask them. Since they are the ones that check, they can give you the info.

He can start the process once you get married, you must be married 2 years to have residency with the ability to work legally. Otherwise you are sort of on probation. If he came to the US illegally then he will need to return to his country for 6-12 mos. He will need to go to the American consulate on 2 ocassions, they will contact you via mail to let you know after having filed the application. I'd suggest that you contact an immigration lawyer, they can fill out the application for you and they will give you a free consultation. He will need to get some medical tests done, they should be able to tell you where, in his country, to do that.

Start by filing an I-485 requesting an adjustment of status from nonimmigrant to legal permanent resident.
