If by 'here' you are referring to the continents of North and South America, people who are in their respective countries are not illegal.

When people refer to illegals in America, they are talking about being illegally in the United States of America, which is commonly abbreviated by all the world (including the rest of these two continents) to be "America". It is much like Mexico being refered to as Mexico rather than by its full name.

Because people use the name "America" to refer to the United States of America does not give a claim for residency in the United States of America to anyone who didn't follow the U.S.'s immigration laws. On the flip side, the fact that the other countries in our two continents refer to us as America doesn't mean we can reside and own property and vote and hold office in any country we please within the two continents, either.

See, e.g., Mexico's immigration laws.
