it's like a lease, you have the title, and some of the money......TAKE IT BACK FOR NON-PAYMENT!!!

You own it according to the title....with out an official bill of sale, it is their word against yours, but YOU HAVE THE TITLE.

be carefull

There are many things that you can do:
1) If the car has not been registered in this persons name and registration is coming due you simply do not allow it to happen.
2) If you sold the car under contract send him/her a certified letter, return receipt that they have a specified time to pay in full or you will repo the car.
3) If this was a gentlemen's agreement and there was no written contract and you have a spare set of keys....take the car back! or if you are not up to this
4) Then report the car stolen, after all there is NO SIGNED agreement!
5) IF you have an agreement signed by the other party and an address you can file a small claims action (depending on your state laws) up to $5,000 plus costs and then turn this into a judgement against the other party.
6) With a signed contract and in some states you can go to the Dept. of Motor Vehicles and lodge a complaint and they wil NOT re-register the car for this person!

There is no way to screw them over legally as you have put it, but you can send them a registered mail informing them that you intend to take the matter to Small Claims Court and if they don't respond in a timely manner do so even if you can't afford a lawyer. Depending on where you live some legal aid societies will help or even represent you in such cases!

It is not screwing them over, it is merley working on legal rights.

You sold a car and they made an agreement to pay you. If they have refused to pay you may take them to court and repo the auto or do other legal action

That's why we have a court system. Take them to court and let the court decide. Most important, have your paperwork completed and in your hands. It will, of course, show the original agreements, dates, everything. If nothing else, you'll know that you've done the right thing, and have obeyed the law. If you went out to make the final payment on a loan and failed to get receipts for it, who would be at fault?

Did you enter into an agreement with the person? If not, go to the police and give a complaint the so and so has taken your car.

If you had an agreement, you could go to courts for settlement.

yes, reposses it.

Call the police department, and tell them you are repossesing your car. That way if/when it gets reported as stolen, they know not to respond.

If you have the title, you are the owner of the car. If you did not deliver the title after agreement was made, they should be able to prove it.

Sure....say they stole the car. Not exactly ethical, but doable. Why haven't they finished paying you? Are they your friend? Can you extend the payments? Do you have an oral agreement or written? That will be the key.

Contact the sheriff's Dept. not the local police.

It's a civil matter. local police won't mess with it, they can't.

tell them, you want your car, and you have the title. They may or may not help you. It's they're choice if they want to or not.

If they are driving this car...if they wreck it....you know who is liable, if this title is still in your name?
