--with a rubber band specifically?

you can have them arrested if you felt in fear of your life. Or, if they robbed you and used the rubber band to threaten you to give up the items.
You can sue them if there was damages as a result of this awful rubber band crime.
Some people should not be allowed the use of rubber bands,

Unless it causes specific and debilitating injury, you'd be laughed out of a lawyer' s office. However, if it did cause such an injury, such as the loss of sight in an eye, then yes, you have a right to demand compensation. If the defendant is an adult, you sue him or her. If a child, you sue the parent or guardian. How large an award you'll get is another story...if the defendant is indigent, or has no insurance, you may be S. O. L. No state will allow you such huge damages that the defendant is left destitute.

You can try, but unless you had some injuries, medical bills or lost wages, you won't get far. If they hit you in the eye and you needed to go to the hospital, you have a case. If they hit you in the arm and you didn't go to the hospital, then the judge will probably tell you to get over it and maybe even fine you for wasting the court's time.

I can see it now, a deep phobia of anything rubber, your life is runined. yes but you have to show how this event caused a loss in your life that can be measured in money.

( it is indeed criminal, if they intended to do it) as an assualt.

If they had knowledge with substantial certainty that you had a great fear of rubberbands...whether irrational or not...then you could. But you'd have to find the right kind of lawyer...you know, the kind without scruples.... :)
