I've checked the lenses for spots and I haven't found any but in the upper to mid left P.O.V for the camera there's a small black spot but it isn't always there.

There's dust on the sensor. Here's a way to clean it:

I suspect there is a piece of dust on the sensor. The most likely reason that you sometimes see it and sometimes you don't is due to the f/stop you made the photo at. A larger f number (say 22) enhances these small bits of dust. If you reshoot the photo with a higher shutter speed and lower f/stop the dust spot will not be as noticeable.

PS I would strongly suggest not going after the dust with a cleaning cloth. If you get it caught in the shutter the delicate mechanism is toast.

sounds like there's dust on the sensor. should be able to clean with a cloth but i'd reccommend compressed air. use actual compressed air though and not the stuff in the can as the propellant will sometimes spit out residue that can further cloud sensors and lenses.

clean the viewfinder & lens (both sides) with proper cloth and if still present may be something internal. Check the shutter mirror(carefully). The moulding for that is adhesive foam and sometimes come loose.

You need to clean the sensor, take your lens off and clean it using a soft cloth and/or a cleaning pen.

Could be dead pixel(s) on the sensor. If cleaning doesn't work, take it back it for a warranty replacement (if it's still under warranty).

There may be a speck of dust on the lens. Have you removed it to examine it?
