The ACLU does not use tax money. They generally represent clients who want to bring lawsuits. Anyone has the right to file a lawsuit. If a lawsuit has no merit, the plaintiff will lose. But if a jury decides in favor of the plaintiff, then by definition the lawsuit is not stupid (unless you want to get rid of our Constitutional right to jury trial). It's not up to you to decide whether someone's lawsuit is stupid or not, unless you are sitting on the jury.
