does the state of michigan have legal claim to your unborn?
and what can someone do to stop cps from taking child after birth?

a friend of my sisters has had her rights terminated in the past. has completed 2 diffrent parenting classes and got her life back on track. has gotten married. she just found out she was pg again. she wants her baby and is a good person she has just made bad choices in the past.

Under Michigan EPIC statute a termination of parental rights only effects the rights to the child for the children named in the order.


This means for any new children a petition to terminate the rights of those new children would need to be filed and the prior termination for other children has no effect over the new children.

If your parental rights has been terminated then yes the state of Michigan has custody of your child. They become a ward of the state. You cannot stop CPS from taking a child. It usually is for the best interest of the child.

in most cases, if your parental rights are terminated, it only effects the children you have now. Any new children don't fall under that. But they will probably keep a close eye on you. But again, it might depend on how serious the situation was that got the others terminated (Wisconsin)

If both parents have had their rights terminated I believe the child goes to foster care until a caregiver can be found, preferably a close relative.

i dont believe that they have rights to the unborn where they can take the child right after birth, but at any time they suspect abuse the can take the child easier since other children have already been taken.

You have no right to all your future unborn children,protective service will take the baby from the hospital.I hope this is your last child.Get yourself together and get your kids back.
