Yes, the law giver is clearly above the law. The Bible states this in fact from God's very own Words. His ways are above our ways. We do not have authority to question God.

God cannot be above the commandments legislated as morality because, if that were the case, that would indicate that the Ten Commandments are an arbitrary set of rules, and thus highly un-objective (the opposite of what those rules claim to be). If this is the case, that God is above the rules, then what would have stopped him from saying that blending up babies is an acceptable behavior if He had 'woken up on the wrong side of the bed'? First there was only 10 commandments, second...you ever see politicians go to jail for anything?(meaning our law givers appear to be above the law why not others)
