If you are only 17 but will be 18 in May of The year "07" and are dating and ilegal citizen and your pregeant with his baby and you are not married and you have his baby will he have to go back to Mexico or does he have the right to stay here? To me it is not right if the law makes him go back because it is his child too and he deserves to watch it grow and be a with us and be a family

Well, he's here illegally, right? You knew that before you became pregnant, right? Of course he should be deported ... and if you are concerned that he won't be able to be with his child ... what's stopping you going with him back to Mexico?? I'm all for families being united ... but why do they always have to be united on American soil??

The only reason they would send him back is if he commits a crime by going to jail. The police cannot even ask for his documentation unless there is probable cause he has commited a criminal act. So don't worry about it. Just because he has a baby by a citizen it doesn't mean he has the 'right' to stay here. Marry the man and help him get his citizenship. Of course only if you plan to stay with him forever. Never do it just for him.

The law will be a law unfortunately, there's not much you personally can do about that one. If he is illegal, well...that's the term of the word, he's illegal. He's not supposed to be here in the first place unrightfully. If he takes the proper methods to becoming a citizen of the U.S., then he would be able to come back legally, but until that point, if you want to raise your baby as a family for the first stages of your baby's life, you may want to move back down to Mexico with him, until he is able to attain citizenship.

Yes, unfortunately for you he will definitely have to go back to Mexico. If you want him to stay and you are in a state that allows you to get married at 17, then do that. I know that you find it unfair, however your boyfriend broke the law, and it is unfortunate for you that their is a baby involved. Why not move with him to Mexico and make a living there.

It is quite possible he will be sent back to Mexico if he is caught. The baby would get to stay, but he'd be sent away.
The law is completely fair. He shouldn't have been here to make the baby, so as part of the punishment for breaking the law, he doesn't get to see his child and you get to learn the responsibility of raising a life when you can hardly take care of yourself.

First of all, I think you mean "illegal alien", not "citizen". I assume you are in the United States. Please correct me if I am wrong.
First you need to know what the legal age for consent is in the state in which you had sex with this person. You do not want him to be charged with statutory rape (sex with a person too young to legally give their consent). You need to know what your status is before you talk to anyone official. Then you need to consider whether or not you want to marry this person now, possibly later. Marriage might give them citizenship or at least residency here. Tak to an attorney who is an immigration specialist. Also see if there is a way this person can make his status legal. There are confidential counselors who help people with immigration and legalization issues. Again, get a lawyer. Please be discreet, because it is a bad time politically for illegal aliens, particularly mexicans. are you close to mexico geographically? the law is very unfair. i totally agree with you, but it is the law, unfortunately.
also, do you know your partner well enough to know if you want to spend the rest of your life with this person or tied to them with a child? you are quite young to be in this position. you need to ask yourself serious questions. is your family supportive? do they like him? will they help? do you have a religious leader you can trust to talk to ie priest, minister, rabbi, or whatever? i wish you happiness and best of luck, whatever you decide.

He entered illegally, therefore could be deported. If he is deported, you can either go to Mexico with him, or you can resign yourself to the fact that you will be a single parent.

The baby does not give him any rights to stay in this country illegally.

How old is he honey? Shoulda thought of all that first. Are you scared for the law to get him cause what he is doing is illegal? He has no rights in this country - any rights he has are in his native country. Your agfe doesnt help him. Why dont you follow him back to Mexico if you love him so much?

I don't see the connection. If he wants to see his child grow then there are three options off the top of my head. You move back to his home country with him and raise your child, or he go back alone and work to enter this country legally. Or you can marry him and work it through that way. That seems to be the simplest way.

They will send him back, as they should. He needs to be a man and become a legal citizen. Go back with him.
