Document the problem, reguardless of any accusations they make as a desperate attempt to defend themselves.

If you have the proof and the documentation, then you are correct. Assuming that there is not any actual "reverse discrimination," then there will not be any proof for that person to present.

Additionally, since "discrimination" generally indicates an opression of a group or individual based on differences, "reverse discrimination" would mean a promotion based on that differnce. I assume, in this case, that the accustion is more "racially motivated" or "gender motivated" than discriminatory.

What is reverse discrimination? Does this mean that you are a minority of some half a million kind that isn't a white male who is suppose to be the only being capable of true discrimination because he is the one in power.What a f*****g joke.If you are afraid of a "reverse discrimination" suit then maybe you are the one with a discriminating mind.

you have to document the underachieving. If you don't document it, you don't have a leg to stand on. After you have a good file going, then the person can be let go without fear of reprisal

...Underachivers know they doing it. And if youve reviewed or told this person its what you suspect and thats the answer you get? See if this person can be reviewd under another supervisor and see how it stacks up.

Sometimes personal issues with discrimination can be resolved by transfering someone to another shift or to another super. if thats not the case you going to have this debait unless we go under some sort of live and death alien invasion where that sort of thing doesent matter anymore.
