The laws vary from state to state on that issue, but it is probably not legal. Here in California, it is legal for parents to serve their children alcohol in limited quantities in their own home, but not in public. The laws of your state may be different.

It's not, but some places won't card you if you're with your parents. If your folks order a bottle of wine for the table and request a certain number of glasses to include you, the server is more likely to serve you per your parents request than if you were to order a drink on your own.

In the US, it is illegal in all 50 states for minors to drink. (The exception is a sip of wine during communion). If the parents allow the underage person to drink while in their presence, the parents could be arrested for contributing to the deliquency of a minor, and the minor could be arrested for illegal consumption.

In addition, if a winery or restaurant serves the minor, they could lose their liquor license. They won't want to risk this, so they should be checking IDs.
