I believe Kurt Busch got cited for reckless driving, the DUI was dropped after the machine failed...so not a good example!
I think Nascar would suspend the driver because they wouldn't want the bad publicity or showing tolerance of that, so the situation on the rules wouldn't matter!
But as far as rules already set on it, I don't know what would be holding them back...with a DUI your license is usually suspended, but evidently you don't need a license to drive in Nascar and it isn't on a public street...so therefore, they could, but probably wouldn't get to!

This is a sticky topic. Technically there are no connections between the civilian jurisdiction and the Nascar regulations. However, the teams, the owners, and NASCAR do hold the driver's accountable for their actions and behavior. They are expected to uphold a clean image, and something such as a DUI definitely tarnishes that. If they were to be arrested and found guilty of DUI or DWI I am sure there would be a harsh penatly handed down, including a suspension and possibly eviction from the sport. The rest would kind of be up to the team and the owners beynd what Nascar passes down.

I don't believe that there is a rule stating that if receiving a DUI a driver cannot participate in the races. Kurt Busch last year was pulled over but was never charged due to a malfunction with my machine. NASCAR did not penalize him but his owner did. Jack Roush made the decision to pull Kurt out of the car for the last 2 races of the season.

Busch had a dui and got suspended. This was due to the code of conduct that they had to live buy. Nascar drivers have to live by the codes on or off course, if they don't it makes nascar and them look bad.
**Also the owners of the cars could have this issue outined in the contract, and being taken out a race might be the penalty**

It depends on the team of course...they can tell the driver no they can't drive. But legally yes they can operate the car because they are on private land. Scott Wimmer got a DUI when he drove the CAT car and had to do all kinds of rehab type stuff through NASCAR. Kurt Busch didn't get an DUI; because of some kind of malfunction with the machine that was used. Shane Hmeil failed drug tests and was allowed to still drive; but he was recently banned for life for consistent drug abuse.

I don't see why they wouldn't be allowed to.
1. They are not on a road under the state's or federal governments control.
2. They have to undergo stringent rules just to be there to begin with, so I am sure someone would notice if they were under the influence of anything to begin with.
3. Isn't there a driver who is young and didn't have a driver's license yet driving in Nascar?

I think the driver of the #22 car got a DUI and had nascar probation. As for kurt bush he was leaving Roush Racing at the end of the year so Jack Roush kicked him out for what he did.

Well, NASCAR wants their drivers to act a certain way that looks good to the public and a DUI makes you look bad. Yes, they can continue to drive but they usually get a good reprimand

Yes, you can, but it depends on the situation.
Kurt Busch's incident was pretty much swept under the rug and I don't think he ever got charged with DUI....only failure to obey an officer, and stuff like that.
Scott Wimmer had one a few years ago and he drives.
Shane Hmiel had a DUI and some other drug problems and he's been suspended for life!
So, I guess it depends on how far you cross the line.
