If your neighbor had a fruit tree whose braches hung over your drive way, and dropped rotten apples onto your property, what would you do?

First speak with your neighbor to inform them of the problem. Perhaps they don't even know. Secondly if they don't take action; you do. I would cut the branches on your side to prevent further apples from landing in your yard.

My answer - I'd be happy to pick the apples before they become rotten. Picking apples off tree branches on your side is legal too. If there are a lot of apples, give them away to friends or make an apple pie.

Maybe you've tried this already but in most cases, diplomacy is best. You can certainly take out your chain saw and hack away but it would be good to talk to your neighbor and let them know. Communicating with other people allows them to feel you are sharing which makes everyone feel better rather than just taking actions solo and ignoring people. In the end, you are better off if you get along with your neighbors - they may be of help to you one day. Remember Androcles and the Lion?

You are legally right to remove branches from trees over your property. But try to be diplomatic first. Discuss it with your neighbor first. Of course offering to do the work or pay for the work in the process. If he says no then make sure you know exactly where the property line is and check with you local government first i.e. the local police or city managers office to confirm you have the right to do so then go ahead.

No need to cause WW3 just because you want a clean car

I don't think so because if an apple falls from your tree into your neighbors yard and you pick it up and eat it it is considered stealing. And it is your neighbors property. Just like if you bang your friends car you might have to pay for the damage but if it is your car you can beat it all you want. Just throw the rotten fruit away.

The law in most jurisdictions would allow you to trim the branches back to the property line, but you need to be carefully not to permanently damage or kill the tree. But I agree with ropdog in that you should really talk to your neighbor first. Ask him/her to trim branches. If your neighbor won't pay for it, then get it done yourself. Just remember that this person might be your neighbor for a long time, so it would be best to try and work things out first.

Absolutely!.. anything that protrudes onto your property without your permission can legally be removed!..

Your property lines is JUST that YOURS.. legally anything that is covering over or has shifted onto your land by erosion is YOURS.. so if apples are the item, pick the good ones to make pies, then get a tall ladder to remove whatever parts that are a nuisance to your vehicles.

I suggest a pole saw rental, since apple trees aren't extremely tall. it should be an easy fix.. but if you can keep a branch for yourself for fresh fruit, thats cool too.

depends on where you live as to the legalilty. Talk to the neighbor first and both of you work together on it, that way, they'll have it cut back the way they want for the saftey of the tree and you'll be able to see if enough is cut back to your liking. If you just go and start cutting.....it could cause more problems than what it's worth.

I would ask them kindly to remove that branch because it is damaging your cars paint and driveway..... than if they don't respect your property you have the legal right to cut that branch....it is called property encroachment!if they were good nieghbors in the first place they would repect your property! so do the math! take a chain saw to it oh if there are any good apples on it keep them ! then chop the h--- out of it! We have this same issue. We have called the city and they will do nothing. You either resolve it with your neighbor or else you take care of it yourself. No, they do not have to pay for it either. It is legal to cut the branches though. I think the entire things sucks myself! It's their tree, why do I have to pay for it and/or do the work!?

If the branches are on your property tell them to cut it off. If they don't you can cut it off. Or just complain to the city and have them fine you neighbors. Your choice
