I did not have any insurance. All im wanting to know does this guy have the legal option in the state of texas to not file it on his insurance? I have all of his insurance information but his insurance company will not do it until he says yes. On the other hand he's not doing anything over here for my totaled car or medical bills.

You are exactly right, i should have had insurance and with this happening will definently learn my lesson.Just thanks God it wasnt my fault.

The police were called there is a report, and not only was the buisness van at fault but it took off running so it was a hit and run but the police caught them.

From the information you provided I take it the other driver is at fault for the accident. I know you would've received a citation for no insurance but you need to get the police involved in auto accidents and especially if any injury exists. Besides he woul've also received a citation for being at fault.
Without insurance you are stuck dealing with him directly if he does not wish to turn in the claim to his insurance. Your only legal recourse is to document your damages by: take pictures of the damaged vehicle, get a repair or total loss value of your vehicle and pay for the medical bills. With all the time and expenditures, you will likely need to hire an attorney to repreesent you.
There is a need to have insurance and this is a prime example why states require driver financial responsibility to drive.

That why you have insurance companies. You need to report this incident/accident to your insurance company (submit photos of the damage) and let them go to work for you. Did you report the accident to the police? You can get a copy of the police accident report - or your insurance company can do that for you. If you haven't filed a police report, you can still do so. The other insurance company is stalling you - contact your insurance company as soon as possible.

Yes he does indeed have that option. In some states if you have no insurance you are totally responsible for your own costs regardless of fault. He can refuse insurance indeed. He has the option of paying it out of his own pocket. He can also withhold insurance payments until you take him to court over it and win. I suggest you hire a lawyer.
