Yes, he is. I have sympathy for any family who loses a loved one. While Mr. Lay may have made some poor choices, his loss of life should not be celebrated. I leave investigations to the proper authorities, and I leave Justice to God.

He certainly has the means and motive to fake his own death, just as Enron had the means and motive of "silencing" a leak and framing the local authorities to paint it as a suicide:

I think he's alive, it's to dam easy for him to be dead, now he doesn't get convicted and his family gets to keep his fortune.
