We have been living in separate residences for nearly six months now and are almost positive we will be divorcing eventually. What are the advantages/disadvantages--if any--of making the separation "legal"? We have been in a relationship for 19 years, married for 4 of those years, and have two children together. Where would I go to file? We live in Ohio.

The best advice I can give is to get an attonery. They know the law better than anyone and can help from start to end, especially if you think divorce is in the future. Usually the 1st visit is free. Sorry to hear about your relation esp. for the kids, I know it's hard.

I have never understood a legal separation. Why go through the expense of it? Either get a divorce or dont. If you have been separated 6 months it looks as if you are not going to get back together, so get a divorce and go on with your lives.

a legal separation is exactly the same as a divorce, same fees, same boundaries only difference is in the end, your still married. You go to a lawyer just like you would if u were divorcing. You don't want to pay twice for the same thing. I did that once. it's all the same, except like I stated before, in the end u r still married.
